Copyright and Monash Professional Development Education Courses: Monash owned resources

• You can use resources you have created, provided you haven't transferred copyright or given exclusive rights to someone else.
• For published articles, it is common to transfer copyright to the publisher, so you may need publisher permission to reproduce an article you have written.
  • If you are a co-author you would also need permission from the other authors
  • The copyright adviser can check your agreement or the policies of the publisher as to what rights you retain.
  • You may need to pay permission fees or open access fees to make the work available. This will need to be factored into your budget.
  • Generally fees are lower if you are one of the authors. In some cases the publisher may waive the fee.
  • You are more likely to get a better response from the publisher if the author contacts them directly, rather than an administrator.
  • In one example, the author did retain some rights to post an older version of the article online, but this was not the preferred version as it didn’t include changes from peer review. So even when you retain some rights under publisher agreements, these rights may not be enough to allow use in the course.

• Provided the author has not transferred copyright or given an exclusive licence to someone else, you can use material created by other Monash staff without special permission. However, it's still polite to let them know.
• If the resource is a published article or book, copyright may have been transferred to the publisher. In this case you may need to seek permission from the publisher.

If you're recording Monash academics, it's good practice to get an agreement in writing stating that they consent to the recording being used for the course.

• As you may want to repurpose the material for use in another course or for other uses (e.g. promotion and marketing), you may need a broader consent to record. Get advice from the Copyright Adviser or Office of General Counsel on template agreements (Monash access only) .

If you are hiring a videographer to make the recordings, make sure you have a proper transfer of copyright in the contract of services, otherwise the contractor will own copyright in the film.

• Get advice from the Office of General Counsel on a standard contract which includes this.

If you are recording guest speakers or interviewing non-Monash participants, you need a written permission form. It should clearly state that the guest or non-Monash participant grants permission for the recording to be made and used in the course.

• You may want to repurpose parts of the course for use in other courses or other purposes (e.g. promotion and marketing) so you need to make sure that your agreement is broad enough to include those uses.
